These terms and conditions apply to the use of the website and services of BenchLab, a product of The Blue Hour Digital B.V. By using our website or services, you agree to these terms.

Article 1 — Definitions

  • BenchLab — the benchmark software platform of The Blue Hour Digital B.V., located in The Hague, the Netherlands.
  • Platform — the web application used to conduct benchmark studies and generate reports.
  • User — the organisation or person that has an account with BenchLab and conducts benchmark studies.
  • Respondent — the person who participates in a benchmark study and receives a personalised report.
  • Benchmark — a study in which individual results are compared with those of a relevant group.

Article 2 — Services

BenchLab provides benchmark software that enables organisations to set up studies, invite respondents and generate automated personalised benchmark reports. Additionally, we offer a GenAI module that generates automated analyses based on research results.

Article 3 — Use of the platform

By using our platform, you agree to the following:

  • You provide correct and up-to-date information when creating an account or setting up a study.
  • You are responsible for the content of the benchmark studies you conduct through our platform.
  • You do not use the platform for purposes that violate the law or the rights of third parties.

Article 4 — Data and privacy

We process personal data in accordance with the GDPR. Please refer to our Privacy Policy for a complete overview of how we handle your data. We never sell data to third parties. For benchmark studies, the user acts as the data controller and BenchLab as the data processor. A data processing agreement is available upon request.

Article 5 — Intellectual property

All rights to the software, design and content of the BenchLab platform belong to The Blue Hour Digital B.V. It is not permitted to copy, modify or distribute parts of the platform without written consent. The data you enter and the reports generated from it are your property as a user.

Article 6 — Liability

BenchLab strives for maximum availability and reliability of the platform but does not guarantee it. We are not liable for indirect damage, consequential damage or lost revenue. Our liability is in all cases limited to the amount you have paid to BenchLab in the twelve months preceding the claim.

Article 7 — Changes

We reserve the right to modify these terms. In the event of material changes, we will inform you by email or through a notification on the platform. Continued use of our services after a change constitutes acceptance of the new terms.

Article 8 — Governing law

These terms are governed by the laws of the Netherlands. Disputes shall be submitted to the competent court in The Hague.
